Georgia federal judge Leigh Martin May denied the defendants’ motion to dismiss the case and found that the claims are not preempted by the FDCA, as the defendants pled. The judge found that the plaintiffs adequately stated their claims and denied the defendants’ argument for a shotgun pleading.
This is a major success for the plaintiffs, as the ruling moves the case into discovery and closer to a successful resolution.
The Paragard MDL (Multidistrict Litigation) case is a product liability case filed against Teva Pharmaceuticals, Cooper Companies Inc., and CooperSurgical Inc., the owners of the Paragard device.
The Paragard IUD is a form of contraception that is inserted into the uterus to prevent pregnancy.
