Georgia federal judge Leigh Martin May denied the defendants’ motion to dismiss the case and found that the claims are not preempted by the FDCA, as the defendants pled. The judge found that the plaintiffs adequately stated their claims and denied the defendants’ argument for a shotgun pleading.

Paragard IUD Case Background

The Paragard MDL (Multidistrict Litigation) case is a product liability case filed against Teva Pharmaceuticals, Cooper Companies Inc., and CooperSurgical Inc., the owners of the Paragard device.

The Paragard IUD is a form of contraception that is inserted into the uterus to prevent pregnancy. Upon removal, the device often breaks and gets stuck in the uterus, requiring surgery that could lead to complications such as injury, infertility, and infection. These instances have led to the product liability suit against the defendants.

This case is nationwide, and the Northern District of Georgia has been selected as the transferee district.
